KNZŌ End User Licence Agreement

Software: KNZŌ for macOS, including any updates delivered through the application

By installing, copying, or using KNZŌ, you agree to this Agreement. If you do not agree, do not install or use KNZŌ, and request a refund under the Refund Policy.

1. Licence granted

Subject to your compliance with this Agreement, we grant you a personal, non-exclusive, non-transferable, worldwide licence to install and use KNZŌ.

KNZŌ is sold in two forms. Your licence key states which one you have, and where the key and this section disagree, the key controls.

When an annual licence ends, KNZŌ does not stop working. Scanning, findings, the explanations behind them, and Recovery all continue to work without any licence at all. Only the actions that change your Mac require a current one.

Your licence key is verified on your Mac, offline. KNZŌ does not transmit your key, your name, your email address, or anything about your files to us or to anyone else in order to verify it.

Because verification is offline, we cannot remotely disable a key. A key that is published or shared may be blocked in a future version of KNZŌ. If we block a key that was shared in breach of §2, we are not obliged to refund it.

4. What KNZŌ does, and what it does not do

KNZŌ analyses storage and system state on your Mac and reports what it finds. Some of its features move files — to the macOS Trash, or, in the case of Apple Mail index repair, into a backup folder KNZŌ creates.

KNZŌ does not delete files. Items it moves go to the macOS Trash or to a backup folder it creates, and are recorded in KNZŌ's Recovery view. They remain recoverable until you empty the Trash or delete the backup folder yourself. Emptying the Trash is your action, not ours.

Restoring what KNZŌ has moved never requires a valid licence. This is a commitment, not a courtesy: it applies if your licence expires, if you remove it, or if you never had one.

Diagnosis is free. Scanning, reporting, and explaining findings do not require a licence. Only the actions that change your Mac do.

5. Full Disk Access and Apple Mail

To do its job, KNZŌ asks for Full Disk Access, a macOS permission that lets it read areas of your disk that applications cannot read by default. You grant it; you can revoke it at any time in System Settings.

KNZŌ's Apple Mail features read, and in some cases write within, your Mail library. In particular, KNZŌ can complete an Apple Mail index migration that macOS itself failed to finish, which involves replacing Mail's index file. This is the highest-consequence action KNZŌ performs. KNZŌ moves the files it displaces into a backup folder rather than deleting them, verifies the installed index before reporting success, and refuses to act while Mail is running.

Even so: keep a current backup of your Mac before using any repair feature. Time Machine, or any backup you trust. This is the single most important sentence in this Agreement, and no clause below is a substitute for a backup you can restore from.

KNZŌ reports "Recovered Messages" mailboxes that Apple Mail creates and hides. It reports them and never offers to remove them, because they may contain the only copy of a message.

6. Privacy

KNZŌ does not collect analytics, does not transmit information about your files, and does not contact a licence server. The only network requests KNZŌ makes are to check for and download software updates, and it asks before it makes the first one. See the Privacy Policy for detail.

7. Ownership

KNZŌ is licensed, not sold. We retain all right, title, and interest in it, including all intellectual property rights. Nothing in this Agreement transfers ownership of KNZŌ to you. You own your own data; we claim no rights in it, and we never receive it.

8. No warranty

KNZŌ IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, express, implied, or statutory, including without limitation any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement.

We do not warrant that KNZŌ will be error-free, that it will detect every problem on your Mac, that its findings will be correct in every case, or that any repair it offers will succeed. Storage devices fail, macOS changes between versions, and Apple's own file formats are undocumented and change without notice.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of profits, loss of business, loss of goodwill, or cost of substitute goods or services, arising out of or relating to KNZŌ or this Agreement, under any theory of liability, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to KNZŌ or this Agreement will not exceed the amount you actually paid us for KNZŌ in the twelve months before the event giving rise to the claim.

Nothing in this Agreement excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law that applies to you.

10. Your responsibility

You are responsible for maintaining backups of your data. You are responsible for reviewing what KNZŌ proposes before you confirm it: KNZŌ shows you the files it intends to move, and every action that changes your Mac requires your explicit confirmation.

11. Consumers

If you are a consumer, you may have rights under the law of your country that cannot be excluded or limited by agreement — including, in the European Union and the United Kingdom, rights concerning digital content that is not as described or not of satisfactory quality. Nothing in this Agreement affects those rights, and where a clause of this Agreement conflicts with them, those rights prevail and the rest of this Agreement continues to apply.

12. Sales and refunds

KNZŌ is resold through Gumroad, Inc., which acts as merchant of record for your purchase. Your payment, receipt, and indirect-tax treatment are handled through Gumroad under its terms in addition to this Agreement. KNZŌ is licensed by us through Gumroad; Gumroad does not own the software or provide product support. Refunds are governed by the KNZŌ Refund Policy.

13. Term and termination

This Agreement takes effect when you first install or use KNZŌ and continues until terminated.

An annual licence reaching its end date does not terminate this Agreement, and is not a breach of it. KNZŌ remains licensed to you as a diagnostic under §1, and Recovery keeps working. Only the actions that change your Mac require a current licence.

It terminates automatically if you materially breach §2. On termination you must stop using KNZŌ and remove it from your Macs. Termination does not affect your ability to restore files KNZŌ has already moved — those remain in the macOS Trash or in the backup folder on your own disk, independent of KNZŌ.

Sections 7, 8, 9, 10, 14, and 15 survive termination.

14. Governing law

This Agreement is governed by the laws of the State of California, United States, without regard to its conflict of laws rules. The courts of the State of California, United States have exclusive jurisdiction, except that a consumer may bring proceedings in the courts of their own country of residence where the law of that country gives them that right.

15. General

This Agreement, together with the Refund Policy and the Privacy Policy, is the entire agreement between you and us about KNZŌ, and supersedes any prior understanding.

If any provision is held unenforceable, it is modified to the minimum extent necessary to make it enforceable, and the rest remains in force.

Our failure to enforce a provision is not a waiver of it.

You may not assign this Agreement. We may assign it in connection with a transfer of the KNZŌ business, including to a legal entity we later form.

We may change this Agreement for future versions of KNZŌ. Changes do not apply retroactively to a licence you have already bought.
